- Representing national real property data provider in numerous federal district court, bankruptcy court, and state court proceedings, including in a dispute involving misappropriation of client’s data and breach of licensing agreements by data licensee. Obtained and collected a multi-million dollar judgment for client, confirmed by a federal district court, and affirmed on appeal.
- Representing Fortune 100 plaintiff against national real estate developer in lawsuit concerning real property rights and other torts arising out of flooding of land. Obtained very favorable settlement for client.
- Represented electronic medical records software developer in various lawsuits brought nationwide, resulting in numerous monetary judgments in favor of our client and the entry of permanent injunctions against software infringers and licensees.
- Represented Irvine-based device manufacturer and corporate officers in minority shareholders’ and shareholder derivative lawsuit alleging breach of fiduciary duty. Week-long bench trial resulted in granting of motion for judgment in our clients’ favor on all counts, and complete dismissal of action.
- Represented national grocery store company in various lawsuits, including actions alleging nuisance, negligence, breach of lease, commercial unlawful detainer, and declaratory relief.
- Obtained permanent injunction on behalf of national radiological technologist test publisher against copyright infringer of clients’ tests.
- Represented international bank in successful defeat of subcontractor’s claims of California mechanic’s lien and stop notice rights arising from Hawaiian commercial development project. Mechanical Wholesale Corp. v. The Fuji Bank, 42 Cal. App. 4th 1647 (1996)
- Represented asphalt emulsions company in prosecution of fraud and intentional interference claims against the largest chemical company in the world. Case settled confidentially after completely defeating defendant’s motion for summary judgment. Western Emulsions, Inc. v. BASF Corporation, 2007 WL 1839718 (C.D. Cal. 2007).
- Represented environmental engineering and civil engineering companies in misappropriation of trade secrets action against former employees and their new employer. Tried six-week jury trial to over a million dollar verdict in clients’ favor.
- Represented telecopier company in a misappropriation of trade secret case against former employees and new employer. After obtaining a temporary restraining order in U.S. District Courts for the Southern District of California and the District of Arizona, case settled confidentially.
- Represented national banks in judicial and non-judicial foreclosures of real and commercial property across the United States.
- Represented national bank in action for intentional interference with contract, interference with economic advantage, and unfair competition. Obtained summary judgment in favor of bank, disposing of case in its entirety.
- Represented Medicare Advantage health plan in bad faith action. Obtained dismissal of tort claims based on financial incentives inherent in managed health care system on federal preemption grounds. Dismissal affirmed on appeal in Yarick v. PacifiCare of California, 179 Cal. App. 4th 1158 (2009).
- Represented health insurance plan and its administrator in an ERISA action. Obtained summary judgment disposing of case in its entirety. McMahan v. United Healthcare Insurance Co., 2012 WL 4052862 (S.D. Cal. 2012).
